YOUR PRIVACY IS IMPORTANT

Creative Goods, Maša Dobrina, s.p., registration no.: 8448531 (hereinafter referred to as “we”) pays great attention to the protection of personal data. This document provides information about which personal data we process, in particular about our customers and users of our online store, whether we process this data on the basis of the given consent or on another legal basis, for what specific purposes we use them, to whom we may transfer them and what your rights are in relation to the processing of your personal data.

When you use our services, we collect different types of information about you, such as your username and password, your contact details and other settings. We track what kind of items you view in our online store, through which device and which of our offers sent via e-mail interested you. Based on this, we produce additional data in order to be able to provide offers according to your wishes and to be able to further improve our online store and services in the future. If you make a purchase with us or create an account, we also process your first and last name, your orders and the data you set on your account.
 
We process the following personal data:

  1. identification data, including in particular first and last name, username and password and, if you are a legal person, VAT ID;
  2. contact data, which includes personal data that we can use to contact you, in particular your e-mail address, telephone number, delivery address, billing address and your social media profiles;
  3. your settings, which include your account information, in particular saved shipping addresses, profiles, newsletter subscriptions, loyalty program memberships, shopping lists, items searched for (“I’m interested”, “follow the price”), your ratings and comments about items and services;
  4. information about your orders, which mainly includes information about the ordered items and payment method, including bank account number, and information about complaints;
  5. information about your online habits, including when you browse the web through our mobile application, in particular information about the items and services you are looking for, the links you click on, how you search and navigate our website and information about the devices from which you access the Internet, such as IP address and associated location, device ID, its technical parameters, such as the operating system, version, screen resolution, the browser selected and its version, as well as data obtained from cookies and similar device recognition technologies;
  6. information about your behaviour in connection with reading the messages we send to you, in particular the time needed to open the message and information about the devices from which you access the Internet, such as IP address and associated location, device ID, its technical parameters such as operating system, version, screen resolution, browser selected and its version;
  7. derived data, including personal data obtained from your preferences, information about items you purchase from us, information about your online habits and reading behaviour about the communications we send you; These are mainly data on gender, age, financial situation, consumption habits and attitudes towards various products and services;
  8. data related to the use of call centres or the visit to the pick-up point, which includes, in particular, telephone call records with the call centre, identification of messages you send to us, including identifiers such as IP addresses, and recordings from video surveillance camera systems at collection points.
We process your personal data in different situations for different purposes. If you visit websites of our online store where we also use cookies, we use your data primarily to determine the number of visitors and improve our services. If you are registered with us, we use your data to administer your account and provide related functionalities. If you make a purchase with us, we use your data to process your order, protect our legal claims and comply with our legal obligations. With the help of your contact details and other data, we can simultaneously show and send you our customized offers.

With your consent, we pass on the data to third parties to display the offer on other websites as well as to provide you with access to some additional services. We have the right to process your personal data on the basis of the preparation or performance of a contract with you, compliance with legal obligations, our legal claims or your consent.

As part of our activity, we process personal data for various purposes and to varying degrees, namely:

  1. without your consent based on the performance of a contract, our legitimate interest or for the purpose of fulfilling legal obligations, or
  2. based on your consent.

What kind of data processing can be carried out without your consent depends on what purpose the appropriate processing is connected with and in what relation to us you perform – whether you are just a visitor to our online store, register with us or buy something. We may also process your data if you are the addressee of goods or services ordered by us, if you communicate with us or visit our pick-up point.

Use of cookies and other technologies, transfer of data to advertising and social networks

If you visit our website and online store, we store small files such as cookies on your device and consequently read small files from it. A cookie is a small set of letters and digits that we store on your web browser or on your computer’s hard drive. Some cookies allow us to link your activities as you browse our pages from the moment you open a web browser window until the moment you close it. The moment you close the web browser window, the corresponding cookies are deleted. However, some cookies remain on your device for a set time and are activated every time you visit the websites that created the corresponding cookies. Furthermore, we also use web beacons (also known as web beacons). These are small images that have a similar function to cookies. Compared to cookies stored on your computer’s hard drive, web beacons are an integral part of web pages. For simplicity, all such technologies will be discussed below as cookies only. We store cookies on your device and also read those stored on your device by our websites. Later in this document, for simplicity, we will talk only about storage.

Some cookies are stored directly on your device by our websites. Such cookies help us:
  • to keep your identification when switching between individual websites of our domain and when visiting again. In this way, your shopping cart is not deleted and we can remember your login via the specific device and do not require you to re-enter your e-mail address and password. At the same time, we may store information about which version of our websites to display if several versions are available at any given time. This is to determine if you have granted us consent in accordance with this document, or if you have decided, for example, to participate in any research;
  • to ensure security, e.g. to verify that your connection to our web domain has not been misused and that someone is not doing business on your behalf;
  • in identifying, studying and removing errors and deficiencies in our websites.

Such cookies and other files are strictly necessary for the operation of our online store. If you disable cookies on your browser, our websites may not function properly, which may prevent us from offering you items from our offer and services.

We also store on your device:

  • Cookies from our websites that enable us to:
      track the number of visits to our websites or individual content, generate statistics and reviews, and measure the effectiveness of advertisements;
    • show different variants of our websites if we test new functionalities;
    • adapt the content of our web to your needs, e.g. prioritize the items you have already searched for and display other offers according to your preferences on our websites.

  • We enable the storage of cookies by third parties who can use them:

    • to collect information about your behaviour on our or other websites;
    • to display personalized offers and targeted advertisements within advertising and social networks on websites outside our domain;
    • to connect with social networks such as Facebook, including automatic login, to provide features such as “Like”, to display personalized offers and targeted advertisements on social networks and other websites outside our website.

For the purpose of displaying personalized offers and targeted advertisements within advertising and social networks on other websites outside our domain, we also provide advertising and social networks with information about your online behaviour. However, we do not share your identification information with such partners. A list of the social and advertising networks we use can be found in the section Who processes your personal data and with whom do we share it?.

The use of third-party cookies and the transmission of your data to advertising and social networks is enabled after your visit to the site and our warning when you click on the “I agree” button, which is an integral part of the warning. This means that you consent to the use of these cookies and the sharing of your data with advertising and social networks.

Use of personal data of website visitors

If you visit the creative-goods.si online store, we process data on your online behaviour on the basis of our legitimate interest (i.e. without your consent) for the purposes of:
  • Obtaining data that will enable us to improve your online store in the future in order to create better conditions for shopping; Our legitimate interest in this case is to improve our services for you.
  • Creating statistics reports and reviews, especially tracking the number of visits to our websites or individual content and measuring the effectiveness of advertisements. Our legitimate interest in this sense is to measure the effectiveness of our websites and advertising costs. For this purpose, we may collect and use other derived data through your online behaviour, or we may share derived information with our commission partners as described in the section Who processes your personal data and with whom do we share it?.
  • Testing new features and apps before deployment, so we can avoid performance issues with these innovations in real operation that could impair your shopping experience at our store. Our legitimate interest in this case is the smooth functioning of our services for you.
  • Measures against attacks and compromises on our websites, and to ensure the security of your data; Our legitimate interest in this case is the smooth functioning of our services for you and the security of your data.
We do not collect information about your behaviour on websites only through cookies. We also supplement them with the following data:
  • IP address of your device (the address of your device through which you communicate with other devices on the Internet);
  • the operating system of your device, its version and language settings;
  • the browser you use on your device, its version and language settings;
  • web address (URL) of the page from which you access our website.
For this purpose, we use personal data for a maximum of 38 months, we store the data only in pseudonymised form.
 
We  process data on your behaviour on websites also on the basis of our legitimate interest (i.e. without your consent) for the purpose of preparing personalized offers and targeted advertisements that we display online. In this case, our legitimate interest is as best tailored as possible and the most effective offer possible for you. For this purpose, we also examine the named data through analysis and obtain derived data from them. Based on this data, we can classify our users into different groups, with each group receiving its own tailored offers. If you buy something else from us afterwards, we will additionally use your order data for this purpose.
 
Therefore, if you searched for a specific product in our online store or clicked on an offer in a message sent to you via e-mail, this product may appear on the first page of our online store on your next visit. Depending on what kind of product you were looking for, we can evaluate which customer group you belong to. Based on this, in our online store we can offer you other items that we believe may be of interest to you.
 
For this purpose, we use personal data for 1 month.

In order to get registered, you must first visit our online store and website, so the processing described under the tab If you visit our website applies to you. If you register, the data processing is extended as follows.

DATA Processing based on the performance of a contract

If you create an account on creative-goods.si, we process your identification and contact data, your preferences and your order data (if you make a purchase with us later) based on the performance of a contract with you (without your consent) so that we can maintain your user account. The contract on which our processing of your data is based is formed at the same time as your account. For this purpose, we use personal data for the entire duration of your account, which you can delete at any time.

DATA Processing based on legitimate interest

If you creative-goods.si create an account in the online store, we process your identification and contact data, your settings and data on your orders (if you make a purchase with us later, even if you make a purchase with us without logging into your account) and data on your online behaviour and behaviour when reading e-mails also on the basis of our legitimate interest (i.e. without your consent), and for the purposes of:

  • obtaining information that will enable us to improve our services for you in the future in order to create better conditions for shopping, in particular by determining your satisfaction with our services. Our legitimate interest in this case is to improve our services for you, and
  • sending tailor-made offers and targeted advertisements, which can be sent to you via e-mail, SMS and social networks, or communicated by phone or other electronic devices, or sent by regular mail or displayed on our websites; Our legitimate interest in this case is the effective promotion of our products and services.

In order to prepare a tailor-made offer, we analyse all the above data and extract other derived data from it, which we use for this purpose. In this way, we may also use information about your online behaviour that we obtained prior to your registration, and we may collect information about your online behaviour even if you have not logged in (e.g. if we identify you using cookies). Based on this data, we can break down our users into different groups, with each group receiving its own tailored offers.

Therefore, if you searched for a product in our online store or clicked on an offer in the e-mail we sent you, this product may appear on the first page of our online store on your next visit. Depending on what kind of product you were looking for, we can evaluate which customer group you belong to. Based on this, we can offer you other products on our websites that we believe may be of interest to you.

Based on our legitimate interest (i.e. without your consent), we may also use your settings to test new features and applications prior to deployment, as described in the If you visit our website tab.

For this purpose, we use your personal data during the existence of your account, which you can delete at any time.

In order to make a purchase with us, you need to visit our online store, so the processing described under the tab If you visit our website applies to you. If you make a purchase with us, the data processing is extended as follows:

Processing data based on the ACTIVE contract

If you make a purchase with us as a person or company, we process your personal data for the purpose of processing your order. These are identification and contact information and information about your orders. If you have a user account with us, we may also use your settings for this purpose.
 
If you make a purchase with us as a representative of a legal entity, we process the same data for the same purpose on the basis of our legitimate interest, which is based on the conclusion and performance of a contract with the person you represent.
 
The use of data for the purpose of processing your order means that we use the data specifically to:
  • have the ability of completing an order online, i.e. not deleting items that you have added to the shopping cart or data from an order under preparation;
  • have the ability to communicate with you, e.g. send order receipts or alert you to the dispatch of items;
  • to receive payment for goods and services,
  • fullfill the needs of the delivery of goods; in this regard, we may also share your data with our transport partners exclusively for the purpose of delivering these goods, as described in the section Who processes your personal data and with whom do we share it?;
  • be able to address  other requests that you address to us, e.g. via the call center, as described in the If you communicate with us through different channels.
For this purpose, we use personal data for the time strictly necessary to process your order or resolve contractual obligations, such as complaints.
 

Data processing based on legitimate interest

If you make a purchase with us, we store your identification and contact information and information about your orders based on our legitimate interest (without your consent) for the purpose of protecting legal claims and our internal records and controls. Our legitimate interest in this case is the protection of legal claims and control over the regular performance of our services.
 
Furthermore, based on our legitimate interest (i.e. without your consent), we process your identification and contact data, your preferences and data on your orders (if you make a purchase with us later) for the purposes of:
  • obtaining information that will enable us to improve our services for you in the future in order to create better conditions for shopping, in particular by determining your satisfaction with our services; Our legitimate interest in this case is to improve our services for you, and
  • tailoring the functions of our web domain to your needs in order to be able to offer you e.g. the nearest collection points when making a purchase, all based on our legitimate interest based on improving and adapting our services; for this purpose, we also process your IP address and the location derived from it,
  • providing tailor-made offers and targeted advertisements, which can be sent to you via e-mail, SMS and social networks, or communicated by phone or other electronic devices or sent by regular mail. Our legitimate interest in this case is the effective promotion of our products and services. In order to prepare a tailor-made offer for you, we analyse all the above data (i.e. your identification and contact information and order data) and extract from it other derived data that we use for this purpose. Based on this data, we can break down our users into different groups, with each group receiving its own tailored offers. If you are not registered with us, we do not use information about your behaviour on the websites to prepare the offers we provide to you.
Therefore, if you have purchased a product from us, we can address you with a tailor-made offer for an extended warranty. Based on your purchase, we can also draw conclusions about which customer group you belong to. Based on this, we can send you an offer for related items that may be of interest to you. If you do not have an account with us, we will not adjust the offers according to what kind of goods you have searched for on our websites, nor according to which links you have opened in the sent offers.
 
For the purpose of creating custom offers and targeted advertisements that we display on our websites, as described in the If you visit our website, we also use information about your orders.
 
We measure your satisfaction with our services based on a survey that we send through a questionnaire sent by e-mail within the Survey Monkey program. The questionnaire is sent to random users who made a purchase from us last month. We have the results of the survey exclusively for our own use.
 
In order to protect legal claims and maintain our internal records and controls, we process data for a period of 3 years and for 1 year thereafter in relation to claims that are enforced by the end of the limitation period. In the event of legal, administrative or other proceedings, we process your personal data for the period necessary for the duration of such proceedings and for the remainder of the limitation period after its completion.
 
For the purpose of protecting legal claims and our internal records and supervision, we process data for the duration of the limitation period, which is 5 years, if necessary, for one year after its expiration in the event of an established claim at the end of the limitation period. When initiating judicial, administrative or other proceedings, we process your personal data for the time strictly necessary for the performance of such procedures and until the expiration of the remaining part of the limitation period after its completion.
 
For the other stated purposes, we use personal data for a maximum of 6 months,
 
You can object to such processing, which is carried out on the basis of our legitimate interest.

Processing Data based on compliance with legal obligations

We, too, have to comply with certain obligations imposed by law. If we process your personal data for this reason, we do not need your consent for such data processing. On this legal basis, we process your identification and contact data, order data, in order to comply with the applicable laws, which at the time of drafting this memorandum are in particular the following:
  • Code of Obligations (OZ),
  • Consumer Protection Act (ZVPot),
  • Value Added Tax Act (ZDDV-1),
  • Tax Verification of Invoices Act (ZDavPR),
  • Accounting Act (ZR),
  • Electronic Communications Act (ZEKom),
  • Prevention of Money Laundering and Terrorist Financing Act (APMLTF-1).
For this purpose, we use personal data for a maximum of 10 years (plus the current year) after the last issued document regarding your order.
If you are the addressee of goods or services ordered from us, we process your identification and contact data:
  • based on our legitimate interest in the purpose of preparing, concluding and executing a contract with our client. The performance of this Agreement is also in our legitimate interest;
  • based on our legitimate interest in obtaining information that allows us to improve our services for you in the future, or on the basis of data to compile our internal statistics and reviews; Our legitimate interest in this case is to improve our services to our customers;
  • for the purpose of implementing legal obligations, in particular under the applicable laws listed in the section on Processing based on compliance with Legal Obligations  in If you make a purchace segment;
  • for the purpose of safeguarding legal claims and our internal records and controls. Our legitimate interest in this case is the protection of legal claims and control over the regular performance of our services.
In order to prepare, conclude and execute a contract with our customer, we use personal data in the time strictly necessary for order processing. After the expiration of this period, we continue to store the data on the basis of our legitimate interest in the purpose of protecting legal claims and our internal records and controls, for the duration of the limited  period, which is 5 years, and if necessary for one year after its expiration in the event of an enforced claim at the end of the limitation period. When initiating judicial, administrative or other proceedings, we process your personal data for the time strictly necessary for the performance of such procedures and until the expiration of the remaining part of the limitation period after its completion. Our legitimate interest in this case is the protection of legal claims and control over the regular performance of our services. For the purpose of fulfilling legal obligations, we use personal data for a maximum of 10 years per order.

 

If you communicate with us through various channels, in particular through our call centres, e-mail, chat rooms and social networks, we process your identification and contact data and records of mutual communications, including recordings of speeches, on the basis of our legitimate interest (i.e. without your consent) for the purposes of:
  • processing your requests; if you have made a purchase with us and your request relates to an order, we may process it based on the performance of a contract with you;
  • records of your requests so that we can verify their regular and timely compliance;
  • proving that we have received and processed your request, e.g. if you order goods from us in this way or in the case you want to make a return;
  • analyses of requirements to improve the quality of our services.
For these purposes, we store personal data for a period of 3 months. If you place an order through one of our channels, we may retain the data to protect legal claims for a limitation period of 5 years and for 1 year after expiration in relation to claims asserted at the end of the limitation period. In the event of legal, administrative or other proceedings, we process your personal data to the extent necessary for the duration of such proceedings and for the remainder of the limitation period after its termination.
If you visit our pick-up point or surroundings, we process recordings from the video surveillance camera system on which you may be displayed, based on our legitimate interest (i.e. without your consent) for the purpose of protecting our and your assets and persons moving in and around the store, which at the same time represents our legitimate interest.
 
For this purpose, we store personal data for a period of 2 months.
In most cases, we process your data for our own purposes as their manager. In such cases,  we share your data with our partners to provide payments, transportation and other matters related to your order. We also transfer data to our data processing partners, who process them in accordance with our instructions. With your consent, we may also share data with advertising and social networks to display custom ads on other websites.
 
All described personal data is processed by us as the manager. This means that we determine the purposes for which we collect your personal data and the processing methods defined in the above paragraph, and that we take responsibility for the proper management of your data.
 
We may also transfer your personal data to other entities that also have the function of a manager, namely:
  • in relation to the processing of your order to our partners involved in order processing, as indicated in the If you make a purchase with us, specifically

    • transport partners, especially the companies Pošta Slovenije d.o.o., Slomškov trg 10, 2500 Maribor, Slovenia, DŠ 25028022 and DPD d.o.o., Celovška cesta 492, 1210 Ljubljana-Šentvid, Slovenia, DŠ SI46749845 if they deliver the ordered goods;
    • the supplier of goods or the service center of the corresponding manufacturer in connection with the complaint of the ordered good or service;
  • Based on your consent, to advertising and social networks, as described in the Use of cookies and other technologies, sharing information with advertising and social networks by name:

For the processing of personal data, we also use the services of other data processing partners who process personal data only in accordance with our instructions and for the purposes described in the section Why do we process personal data and why are we entitled to do so?. Such data processing partners are:
  • cloud providers and other suppliers of technologies and support, such as
    • Webtasy, d. o. o., Slovenia, Registration No.: 1883763000

  • managers of marketing tools, such as those that help us optimize the web and personalize content and offers for you;
    • Google Ireland, located in Gordon House, Barrow Street, Dublin 4, Ireland (BigQuery Services, ChannelAdvisor),
  • To prepare a survey on user satisfaction with our services and products, such as:
    • SurveyMonkey Europe UC, established at 2 Shelbourne Buildings, 2nd Floor, Shelbourne Road, Ballsbridge, Dublin 4, Ireland;
  • Suppliers of recording, access and arrival recording systems installed on Creative Goods’ premises.
For the most part, we obtain personal data directly from you through our online store or when communicating with you. We may also receive some other information from our partners, e.g. banks or transport companies.
 
For the most part, we process personal data that you provide directly to us when ordering products and services, when creating and using an account, or when communicating with us, for example with a call center. We also obtain personal data directly from you by monitoring your online habits when browsing our online store or reading our messages, by recording calls through call centres and by recording video surveillance cameras at our pickup points and their surroundings.
 
If you make a purchase with us, we may receive additional information about your orders from banks, our partners operating payment systems and transport partners in connection with the execution of the concluded purchase contract, e.g. information about your account number, successfully made payments or delivery and collection of goods.
In some cases, we may also transfer your personal data to countries that are not members of the European Economic Area.
 
As part of the transfer of data to the recipients listed in the section Who processes your personal data and with whom do we share it?, we may also transfer your data to third countries outside the European Economic Area, where an adequate level of protection of personal data is not necessarily ensured. Any such transmission will take place only if the recipient in question undertakes to comply with the standard contractual clauses issued by the European Commission, which are available at http://eur-lex.europa.eu/LexUriServ/LexUriServ.do?uri=OJ:L:2004:385:0074:0084:CS:PDF.
You have a number of rights in relation to your personal data. These include the right of access, review, erasure and restriction of processing, transfer, objection and subbmiting a complaint. Just as we have our rights and obligations regarding the processing of your personal data, you have certain rights in relation to the processing of your personal data. These rights include:

Your Right to know

Simply put, you have the right to know what kind of data we collect about you, for what purposes and for how long, where we obtain your personal data from, to whom we share it, who processes it in addition to us and what your other rights are in relation to the processing of your personal data. You can also ask us to confirm whether or not we collect personal data relating to you and, if so, you have the right to know about it. In accordance with the right to know, you can request a copy of your personal data that we processed,  whereby we will provide you with the first copy free of charge, and each subsequent copy for a fee.

 

RIGHT TO RECTIFICATION

To err is human. If you notice that the personal data we hold about you is incorrect or incomplete, you have the right to request that we correct or complete it as soon as possible.

 

THE RIGHT to DELETe YOUR DATA

In some cases, you have the right to have your personal data deleted. We will delete your personal data as soon as possible if any of the following reasons are met:
  • we no longer need your personal data for the purposes for which we processed it;
  • you have withdrawn your consent to the processing of personal data, which is data for the processing of which your consent is necessary, and at the same time we have no other reason for further processing of this data;
  • you have exercised your right to object to data processing (see lower section Right to object to data processing) for personal data that we process on the basis of our legitimate interest, and we realize that we no longer have legitimate interests that would justify further processing of this data, or
  • You assume that the processing of personal data carried out by us no longer complies with generally binding legal regulations.
Please be aware, however, that even if any of the described reasons are met, this does not mean that all your personal data will be deleted immediately. However, this right cannot be exercised if the processing of your personal data continues to be necessary for the fulfilment of our legal obligations or for the establishment, exercise or defence of our legal claims (see section Why do we process personal data and why do we have the right to do it?).
 

Right to restriction of data processing

In some cases, in addition to the right to delete your data, you can also exercise the right to restrict the processing of personal data. This right allows you to request that your personal data be specifically marked and excluded from any processing operations in certain cases – in which case the effect is limited in time (and not permanent, as in the case of the right to erasure). We must restrict the processing of personal data:
  • if you contest the accuracy of personal data until we have agreed which data is correct;
  • if we process your personal data without a proper legal basis (e.g. beyond the envisaged scope) and you will only give preference to restricting it instead of deleting such data (e.g. if you anticipate that you will provide us with this data in the future);
  • if we no longer need your personal data for the purposes described above and you need it to establish, exercise or defend your legal claims, or
  • if you file an objection to data processing. The right to object is described in more detail below under the heading Right to object to data processing).
  • At the time of processing your objection, we must restrict the processing of your personal data.

RIGHT TO DATA PORTABILITY

You have the right to obtain from us all your personal data that you have provided to us and that we process on the basis of your consent and based on the performance of a contract. We provide your personal data in a structured, established and machine-readable format. Easy data transfer is only possible for data that we process automatically in our electronic databases.

THE RIGHT TO DENY THE PROCESSING OF YOUR PERSONAL DATA

We will fulfill your request as soon as possible, but in any case within one month.
