Our terms and conditions
The general terms and conditions of the Creative Goods online store are drawn up in accordance with the Consumer Protection Act (ZVPot), the Personal Data Protection Act (ZVOP-1) and the Electronic Communications Act (ZEKom-1).
 
The Creative Goods online store (hereinafter also referred to as the “Store”) is managed by Creative Goods, Maša Dobrina s.p., Janževa gora 7B, 2352 Selnica ob Dravi, registration number: 84453000, tax number: SI28467809, which is also an e-commerce service provider (hereinafter also referred to as the seller or Creative Goods).
 
The Terms of Use govern the operation of the Creative Goods online store, the rights and obligations of the user and the Store, and govern the business relationship between Creative Goods and the customer. The Terms of Use also govern the individual purchase rules at Creative Goods’ pick up points.
 
The buyer is bound by the Terms of use that are valid at the time of purchase (placing an online order). When placing an order, the user is individually reminded of the Terms of Use  and confirms his familiarity with them by placing an order. Terms of Use are also available for inspection at Creative Goods s.p. pick up points.
By signing in to the online store once via email, the visitor becomes a guest of Creative Goods, and by confirming registration to the Creative Goods Web Store, he/she becomes a member of Creative Goods. Both the guest and a member of Creative Goods (hereinafter also the user) acquire the right to purchase from the Creative Goods online store.
 
When a potential customer orders a brochure with our services, he also registers as a member, and gets a brochure sent to the e-mail address for download and viewing.
 
Visitors also need to register and become members in order to subscribe to our newsletter and to obtain the right to comment on our blog posts.
 
Visitors can register to become a Creative Goods member both online and via a mobile device.
 
When registering as a Creative Goods member, the visitor obtains a username identical to their e-mail address and a password. A Creative Goods member’s username and password unambiguously identify and associate with the information you enter.
 
Registration is also possible during the purchase process.
 
If at any time later the user wishes to change his e-mail address to another one, he must send a request for this to info@creative-goods.si. The change of e-mail address will take place on the same or no later than the next working day, and the user will be notified of this by e-mail.
 
You can also purchase certain items that are in stock at each Creative Goods pickup point without signing in to the Creative Goods online store at a regular price.
Creative Goods undertakes to provide the following information to the customer before being bound by the contract or offer:
 
  1. Creative Goods company information (company name and registered office, registration number).
  2. Contact information that enables the user to communicate quickly and efficiently (e-mail, telephone).
  3. Essential characteristics of the products (including after-sales services and warranties) and the expiration date of this information.
  4. Availability of items (every item offered on the website should be delivered within a reasonable time).
  5. Terms of product delivery (and method, place and time of delivery).
  6. The prices, which must be clearly and unambiguously determined and make it clear whether they already include taxes and transport charges and other charges, and the period of validity of this information.
  7. The method of payment and delivery or fulfillment, and the validity period of this information.
  8. The validity period of the offer.
  9. The period within which it is possible to withdraw from the contract and the conditions for withdrawal (description of the right of withdrawal in accordance with Article 43c ZVPot; in cases where the consumer does not have a right of withdrawal in accordance with Article 43 of the ZVPot, he/she is explicitly informed about this).
  10. Explanation of the complaint process, including full details of the contact person or customer service.
Due to the nature of online business, Creative Goods’ offer is updated and changed frequently and quickly.
 
The price on the Creative Goods online store appears as Online price and Regular price. The online price applies to all registered Creative Goods users (that is, users who trust their data to Creative Goods). You become a registered Creative Goods user by registering in the online store as a Creative Goods member or signing in to the online store once as a Creative Goods guest. At the pick-up points, individual items are available for purchase and display the Regular Price and the Online Price.
 
The regular price is the price that applies to non-registered users who are not members or guests of the Creative Goods online store and nevertheless wish to make a purchase at one of the Creative Goods pickup points / outlets, Maša Dobrina s.p.
The best offer of the day is a specially discounted item price, valid over a period of 24 hours (0:00 to 23:59 on that day) for certain items marked at a discount in the Creative Goods offer that are valid until stocks are exhausted. The percentage reduction according to the regular price is indicated next to the item, and the best daily offer – the price of for the day.
  • The item marked “What’s new” is a newly added item to the Creative Goods range. With this marking, he will be exposed to a minimum of 14 days and a maximum of 2 months.
  • An item marked “Sale” has an additional discounted price compared to the online price valid until the stock of that item is exhausted. The percentage reduction is indicated next to the item.
  • An item marked “Currently out of stock” is currently not available. This means that neither the Creative Goods central warehouse nor the supplier is in stock.
  • An item marked “Sold out” is no longer available. This means that the item will no longer be available.
  • The item marked “Excellent price” allows the buyer to purchase the item at a particularly affordable price according to the online price. A “Recommended” item is recommended by a Creative Goods sales consultant to purchase due to the characteristics of the item and/and the excellent price. A recommendation intended for a wider range of people does not take into account the needs and characteristics of an individual customer, so the purchase decision must be made for themselves by each buyer and Creative Goods assumes no responsibility for it.
  • A “Last item” item is the last item in stock at the Creative Goods central warehouse, enabling faster delivery of the item.
  • Skinned packaging: The item has the packaging open, but it is impeccably working and perfect. The price is further reduced, the stated warranty period applies.
  • Damaged packaging: The item has damaged, incomplete or non-original packaging, but is malfunctioning. The price is further reduced, the stated warranty period applies.
  • Damaged item: The item has minor aesthetic damage, may show signs of use and may have damaged packaging. The price is further reduced, the stated warranty period applies.
  • Item used: The item has been returned by the customer. It has been used and may have slightly damaged packaging. The price is further reduced, the stated warranty period applies.
  • Serviced item: The item has been serviced at an authorized service. The item is flawlessly functioning. The price is further reduced, the stated warranty period applies.
The purchase agreement between Creative Goods and the buyer is concluded in the Creative Goods online store at the moment when Creative Goods sends the customer the first electronic message about the status of his order (titled: Order confirmation). From that moment on, all prices and other conditions are fixed and apply to both Creative Goods and the customer.
 
A person with the data stated when placing an order is considered a buyer. You cannot change the account information later.
 
The purchase contract (i.e. the first electronic order status message) is stored electronically on a Creative Goods server.
Creative Goods offers the following payment methods:
  • cash on delivery*
  • by transferring to your Creative Goods account account according to quote/proforma invoice**
  • by debit or credit card (MasterCard®, Visa, Visa Electron, BA Maestro, Diners club)* *

* For individual orders, we reserve the right to request payment by transfer to your Creative Goods account according to the offer/pro forma invoice, and the same price will still apply.

**Upon receipt of payment according to the offer/pro forma invoice, the order goes further into the processing process.

At Creative Goods pickup points, it is possible to pay by cash, debit or credit card (MasterCard®, Visa, Visa Electron, BA Maestro, Diners Club – only for holders of new cards). Payment with vouchers is not possible.

When paying by credit card online, in case of cancellation of the order or change of payment method, you inform us on the info@creative-goods.si for crediting the card or refunding the purchase price. Please include the order number in your message.

After delivery of the ordered items, Creative Goods also sends the invoice to the buyer in pdf format to the customer’s e-mail address. In case of personal pick-up at the pick-up point, the buyer receives a printed invoice for the purchased items upon their collection.
 
The invoice breaks down the price and all costs related to the purchase and gives notice of the right of withdrawal.
 
The buyer is obliged to check the correctness of the data before placing the order. Later objections regarding the correctness of issued invoices are not taken into account.
 
 
 
Online price
 
The online price applies to all registered Creative Goods users who have trusted us with their data. You become a registered Creative Goods user by registering in the online store as a Creative Goods member or signing in to the online store once as a Creative Goods guest.

Regular price
 
Purchases of unregistered users are subject to a regular price. Items are available for purchase at regular price exclusively at Creative Goods pickup points. The regular price is usually higher than the online price. Customers can also register as a Creative Goods member or place an order at pickup points, enjoying online price benefits by trusting Creative Goods.
 
When buying at the pick-up point, it is not possible to redeem gift certificates, bonuses, promotional codes, etc.
 
Where only one price is displayed next to an item, it means that the online price and regular price are the same. However, when an item is crossed out, it means that registered buyers of the Creative Goods online store have the option to buy the item at an online price.

All prices include VAT, unless explicitly stated otherwise.
 
Prices are valid at the time of placing the order and do not have a predetermined validity.
 
Prices are valid in case of payment with the above-mentioned payment methods, under the above conditions.
 
Despite the tremendous efforts to provide the most up-to-date and accurate information, it may happen that the price information is incorrect. In this case, or in the event that the price of the item changes during the processing of the order, Creative Goods will allow the buyer to withdraw from the purchase.
 
Discounts, promotional codes, etc. as a rule, they do not add up. The discount on each item and the promotional code add up.
 
Paid funds under gift certificates, bonuses and pro forma invoices are not interested. Gift cards and discount bonus codes cannot be exchanged for cash.

At Creative Goods pickup points. individual items are available for purchase at a price equal to their price from Creative Goods. All published prices at the pick-up points include VAT. When buying at the pick-up point, it is not possible to redeem gift certificates, bonuses, promotional codes, etc.
In case of payment with debit or credit cards, the following conditions apply:
 
  • The payer (data in the user’s account) must be the same person or organization as the owner of the payment or credit card.
  • After confirming receipt of the order, it is not possible to change the content of the order or the final amount of the order, except in exceptional cases with the approval of Creative Goods.
A gift card is a paper issued electronically by a Creative Goods retailer for a fee (the buyer receives an e-mail with a gift card code). Each gift card is marked with its own code (unique serial number), and the seller of Creative Goods, Maša Dobrina s.p. is obliged to accept it as payment for purchases through the Creative Goods online store.
 
A gift card can be purchased from a Creative Goods online store. The purchase of a gift voucher is subject to the same provisions of the terms and conditions as for the purchase of items other than the method of payment. The gift voucher can be paid by debit or credit card. In case of a larger gift card order, you can send your inquiry to info@creative-goods.si. In this case, the possibility of payment is by proforma invoice.
 
The validity of the gift voucher is 3 months from the issuance of the voucher, unless otherwise indicated on the voucher.
 
It is not possible to exchange a gift card for cash. The voucher is redeemable only in the full amount. In the event that the value of the purchase is higher than the value of the gift certificate, the holder of the gift voucher must pay the difference. The total value of the items must be 1 € higher than the value of the gift certificate. With a gift card, you can pay the total amount of items, but not the delivery costs.
 
Use of gift certificate:
  • Select the goods you want to buy and put them in the cart. Go ahead and finish your order. Select the delivery method, provide the delivery address and select the payment method.
  • In the Gift card or discount code field, enter the gift card code and confirm by clicking on the “Apply” button. To redeem multiple cards, separate each code with a space or comma.
  • When you enter the codes, the value of the gift cards is automatically deducted from the price of your order. The amount remains to be paid.
  • Then just place an online order.

Within one online order, we allow you to use multiple gift cards and promotional codes simultaneously, while a discount code can only be entered by one. You can easily enter all of the above during the online order by separating individual codes with a space or a comma.

If the order or part of the order is cancelled and therefore the gift certificates are not redeemed, we will replace the vouchers with new gift certificates. We will refund the paid money to your checking account or credit card if you have made a purchase with it. All you have to do is let us know the redeemed gift card codes and your transaction account number.
The discount code brings various benefits when buying through the Creative Goods online store and is time-limited. You can find the active discount code on the title page of the advertising message, on the page of each department, in our newsletter or other media.
 
In the event that the buyer takes advantage of the discount code, but later cancels the order with the used code himself at his own will, he is no longer entitled to a new benefit from this code.
 
Codes can only be redeemed for items that are Creative Goods carriers.

Using a discount code:
  • Select the items you want to buy and put them in your cart. The value of your order must be at least 1 € higher than the value of the discount code. Once you have finished adding items to your cart, proceed by clicking on the button Checkout. Select the delivery method, provide the delivery address and select the payment method.
  • In the same step, enter the discount code in the Gift card, promo code or discount code into the field and confirm your entry by clicking on the “Apply” button. In case you want to redeem multiple discount codes at the same time, enter them in the field at the same time and separate them with a comma or space. Then click the “Apply” button.
  • Only one discount code can be used to purchase one item. The number of discount codes cannot exceed the number of ordered different items (for example: when ordering 4 items, you can use up to 4 different discount codes at a time).
  • When you enter discount codes, the value of the discount codes is automatically deducted from the price of your order in the last step – Order summary. The amount remains that still needs to be paid.
  • A discount code is a one-time code, which means you can only use it once.
  • The combination of different forms of benefits (discount code, promotional code and bonus) within the same order is not possible.
The promo code brings various benefits when buying and is time-limited. You can find an active promotional code on the title page of the advertising message, on the page of each department, in our e-intelligence officer or other media.
 
In the event that the buyer uses the promotional code, but later cancels the order with the used code himself at his own discretion, or the shipment is damaged during transport, the new benefit from this code is no longer entitled.
 
Codes can only be redeemed for items that are Creative Goods carriers.
 
Using a promo code:
  • Select the items you want to buy and put them in your cart. Once you have finished adding items to your cart, proceed by clicking on the button “Checkout“. Select the delivery method, provide the delivery address and select the payment method.
  • In the same step, enter the promotional code, Gift certificate, promotional code or discount code in the field and confirm your entry by clicking on the” Apply” button.
  • Only one promo code can be redeemed in each purchase (for example: you can use up to 1 promotional code at a time when ordering 2 items).
  • The value of your order must be at least 1 € higher than the value of the promotional discount code.
  • In case you want to use a discount code in addition to the promotional code, the number of codes should not exceed the number of ordered different items. Enter the different codes simultaneously in the gift cards, promo code, discount code field and separate them with a comma or space. Then click the “Apply” button.
  • When you enter a promotional code, the value of the promo code is automatically deducted from the price of your order in the last step – Order summary. The amount remains that still needs to be paid.
  • The combination of different forms of benefits (discount code, promotional code and bonus) within the same order is not possible.
Getting a bonus for your next purchase:
 
The user receives a bonus when purchasing items through the Creative Goods online store, which also indicate in the description the acquisition of the bonus for the next purchase (and its amount).
 
The bonus for the next purchase is issued electronically (the buyer receives an e-mail with a bonus code) 14 days from the receipt of the order, unless otherwise stated. Each bonus has its own discount code (unique serial number) and is obligated to consider it as a discount for a predefined item/category or for any item (if specified) sold on the Creative Goods online store. When ordering a bonus item, there may also be a limit on redeeming the bonus for the next purchase (depending on the value or content of the purchase).
 
 
How to redeem a Bonus:
 
The attachment that the user receives to his e-mail address, together with the bonus discount code, defines the terms of use of the bonus – usually use is conditional on a purchase above a certain amount (e.g. a bonus of 10 € for purchases over 100 €). When redeeming the earned bonus, the value of your order must be equal to or higher than the conditional amount (e.g. purchase over 100 €) or (if there is no other condition) the purchase value must be at least €1 higher than the value of the discount bonus. The bonus can only be used in a lump sum and cannot be used partially. The validity of the bonus is 3 months, unless otherwise stated.

Within one online order, we allow you to use multiple gift cards and promotional codes simultaneously, while discount bonus codes can be entered as much as there is in the item cart. You can easily enter all of the above during the online order by separating individual codes with a space or a comma.
 
The number of allowed discount bonus codes you wish to use within one order is limited to the number of items you have in your cart (for example, when ordering 4 items, you can use up to 4 different discount bonus codes at a time).
 
If you want to use several identical bonuses at the same time (e.g. 2) and the bonuses have a limit (e.g. purchases over €100), you must meet the condition again to redeem each bonus (you must have at least 2 items in your cart above €200 to redeem 2 bonuses over €100).
 
The combination of different forms of benefits (discount code, promotional code and bonus) within the same order is not possible.
 
In the event that the buyer redeems the bonus, but subsequently cancels the order with the redeemed bonus, at his own will, he is no longer entitled to the new bonus.
The set is a set of two to six items. When you buy an item through the Creative Goods online store, the system offers you other items to save on price. For an additional item inside the set, special savings apply, which will be visible in the cart before placing the online order.
 
Gifts added to individual items are not preserved when the set is created (sets are always created without gifts). Within the different sets, savings vary.
 
You can also redeem a gift card, promotional code, discount code when buying a set. The number of discount codes should not exceed the number of ordered different items (for example: the set consists of 2 items, which means that you can only redeem 2 discount codes at a time). Enter the different codes simultaneously in the gift cards, promo code, discount code field and separate them with a comma or space. Then click the “Apply” button.
 
The organizer of the contest is the seller Creative Goods, Maša Dobrina s.p., Janževa gora 7 B, 2352 Selnica ob Dravi. The participant in the raffle is a person who participates in the announced prize campaigns.
 
Prize winners are determined randomly by the computer selection function or set by the organiser’s committee and rules of the game.

 

RIGHT TO PARTICIPATE IN THE PRIZE GAME (AND OTHER PRODUCT OR VOUCHER AWARDS)

 
Participants in the contest can be persons who are citizens of the Republic of Slovenia. The prize game is not open to persons employed by the giveaway organiser and their immediate family members, as well as persons employed by other legal entities related to the implementation of this prize contest. Legal entities cannot be a participant in the prize game. The prize game is not open to persons who do not accept the rules of the prize game. The participant is deemed to have accepted the rules of the contest by participating in the announced prize game.
 

RULES OF PARTICIPATION IN THE PRIZE CONTEST

Participation in the contest does not require the purchase of services or products of the giveaway organiser.

ELECTRONIC PRIZE DRAW

All participants in the contest can participate in the draw. One participant can only participate in the prize draw once. The result of the draw is final. No appeal is possible. The winner will be notified of the receipt and method of claiming the prize by e-mail.

OBLIGATIONS OF THE WINNER

Payment of the prize in cash is not possible, nor can it be exchanged for another item. The winner is obliged to provide the organiser of the contest with his/her personal data – name, surname, address, e-mail address, telephone and tax identification number – in writing (e-mail) no later than two days after receiving notification that they are the winner of the prize.
 
Payment of all taxes on prizes (including VAT) is the responsibility of the organizer. The organizer will send a certificate to the prize winners in accordance with the Personal Income Tax Act and the Personal Income Tax Data Delivery Policy. The winner is obliged to report the value of the prize in the income tax return. When claiming the prize, the winner is obliged to complete a statement of acceptance of the prize. The Organizer is not responsible for taxes that may arise in connection with any other prizes. If the winner fails to fulfil all obligations, it is considered that the winner does not wish to accept the prize and thus the organizer is free from all obligations under this prize game vis-à-vis the winner and acquires the right to dispose of the prize for any other purpose. Rewards are non-transferable.
 
If the organiser of the contest does not receive all the necessary information within three (3) working days from the moment he sends the winner notice that they have been drawn for any reason (e.g. the winner declares that they do not want to accept the prize, the address or e-mail address is incomplete or incorrect, etc.), and the statement that they wish to receive the prize shall be deemed to be that the winner does not wish to accept the prize and thus the organizer is free from all obligations under this prize game in relation to the winner and acquires the right to dispose of the prize for any other purpose.

PROTECTION OF PERSONAL DATA

The giveaway organiser shall protect all personal data obtained from the participants during the execution of the contest in accordance with the regulations governing the protection of personal data. The organizer may use personal data obtained from participants exclusively for the purposes for which they were obtained. The participant of the contest agrees that the organizer can send him notifications regarding the offer of the organizer. The participant or his/her guardian or legal representative may at any time revoke his/her consent to the use of personal data obtained in the prize game for direct marketing purposes.
 
The giveaway organiser reserves the right to organise the award ceremony as a public event. By participating in the prize game, the participant allows his name and address to be used in the audio, photo and video material of the giveaway organizer. The winner allows the giveaway organiser to publish their personal data in the media and on the Internet in order to inform about the results of the draw or to collect the prize.

PUBLICATION OF THE RULES OF THE CONTEST

By submitting their data via the input form on this page, participants of the contest agree that they are familiar with the rules and undertake to comply with the rules of the prize game. In the event of any dispute or ambiguity, these Rules shall be considered primary in relation to any other publication, whether in print, electronic or any other form.

1. PLACING THE ORDER

After placing the order, the customer receives a notification by e-mail that the order has been accepted.
 
A Creative Goods member is always accessible on the Creative Goods website with comprehensive information about the status and content of the order. Creative Goods reviews the order, checks the availability of the ordered items, and confirms or rejects the order with a reason. Creative Goods may call the customer at their contact telephone number to verify information or to ensure accuracy of delivery.
 
When delivering items that Creative Goods does not have in stock in its own warehouse, Creative Goods is solely bound by the delivery by its supplier and to the time during which that supplier can deliver the item to Creative Goods. Via e-mail, Creative Goods informs the customer about up-to-date information regarding the delivery of items. If the delivery period is very long and the buyer does not want to wait, the buyer can inform Creative Goods, who will remove the item from the order and return to the buyer any funds already paid in, and the rest of the items from the order at the customer’s choice or supply or cancel the entire order.
 
If a Creative Goods supplier does not confirm the availability of the ordered items no later than two weeks from the date of placing the order, Creative Goods may reject the buyer’s order for the reason the item is unavailable. On the day of rejection, the buyer’s order ceases to be valid.
 
Creative Goods assumes no liability for damages resulting from longer delivery times or non-delivery of items that Creative Goods is not in stock in its own warehouse, unless intentionally or negligently caused by Creative Goods or the person responsible for it.

2. ORDER IS PROCESSES / ORDER IS READY FOR DELIVERY

Creative Goods prepares, dispatches or prepares the item for personal collection within the agreed deadline and notifies the customer by email and SMS.
 
In the event that the buyer decides to cancel the order in time, he must immediately inform the seller about this by e-mail to the address info@creative-goods.si. If it happens that the order has already been shipped, the shipment is rejected by the buyer to the delivery service. In case of personal pick-up (when the item is ready to be picked up), the buyer also communicates his wish to cancel the order via the e-mail above.
The purchase procedure for legal entities is exactly the same as for ordinary customers, except that in the first step you select the account option per company and confirm your agreement to the terms and conditions. If you’ve already made purchases on a business, just select it from your archive.
 
If you want an invoice with your business information, you accept the terms and conditions that apply to businesses. The main difference is in the possibilities of withdrawal from the contract: we enable companies, sole proprietors and other legal entities to return the delivered items within the warranty conditions. The listed legal entities do not have the possibility to withdraw from the contract within 14 days of receiving the item without a reason, as is the case for consumers.
 
Refunds for legal entities are not possible. Creative Goods Terms of Use also apply to corporate purchases, and you can read more about return options under the warranty terms later on the return page or on the returns page.
 
The Creative Goods online store offers legal entities the following payment methods:
  • cash on delivery* (limit of cash payments of up to €420 VAT incl.)
  • by transfer to your Creative Goods manager account by quote/pro forma invoice
  • by debit or credit card (MasterCard®)
  • deferred payment (applies to public and local government organisations and companies that achieve an adequate credit rating).

*For individual orders, we reserve the right to request payment by transfer to your Creative Goods account according to the offer/pro forma invoice, while still applying the same price.

The consumer (this applies exclusively to person who acquires the item for purposes for their personal use,  may not be for profitable reasons) has the right to notify the seller within 14 days of receiving the items that he is withdrawing from the contract, without having to state a reason for his decision. The deadline begins to count one day after the date of receipt of the items.
 
The consumer communicates the withdrawal from the contract to the seller’s e-mail address: info@creative-goods.si. Appended in the message must be an invoice and this filled out form.
 
In case of withdrawal from the contract, the consumer returns the received item either by mail to the company’s address: Creative Goods, Maša Dobrina, s.p., Osterčeva ulica 1, 2000 Maribor, or personally brings it to one of the seller’s pickup points.
 
The return of received items to the company within the deadline for withdrawal from the contract is considered a notice of withdrawal from the contract.
The consumer must return the item to the seller undamaged and in the same quantity, unless the item is destroyed, defective, lost or its quantity has decreased, without the fault of the consumer. The consumer may not use the items unhindered until the withdrawal from the contract. The consumer may view and test the items to the extent strictly necessary to establish the actual situation. The consumer is liable for the decrease in the value of the goods if the reduction is due to conduct that is not strictly necessary to establish the nature, characteristics and functioning of the goods.

The only cost borne by the consumer in connection with the withdrawal from the contract is the cost of returning the items (which, in case of shipping, is charged according to the price list of the delivery service and depends on whether it is a shipment/package/cargo). The item must be returned to the seller no later than within 30 days from the sending of the notice of withdrawal from the contract (purchase).
 
The consumer shall not be entitled to withdraw from the contract in contracts which have as their subject an item which has been manufactured according to the exact instructions of the consumer, which has been adapted to his personal needs, which, by its nature, is not suitable for return, which is perishable or to which the expiration date has expired. There is no possibility of withdrawal from the contract when purchasing software or audio and video media if the consumer has opened the security seal.
 
Withdrawal from the contract is not possible for the following goods:
  • for goods or services the price of which depends on fluctuations in markets beyond the control of the business and which may occur within the period of withdrawal;
  • for goods that are manufactured according to the exact instructions of the consumer and adapted to his personal needs (customizable 3D prints and art pieces);
  • for goods which, by their nature, are unfit for return, perishable or expire rapidly;
  • for the service provided, if the business fully performs the contract and the performance of the service has begun on the basis of the consumer’s prior express consent and with the consent to lose the right of withdrawal when the business fully performs it;
  • sealed audio or video and computer programs, provided that the consumer has opened a security seal after delivery;
  • goods which, by their nature, are inseparably mixed with other objects;
  • digital content which is not supplied on a tangible medium, provided that the performance of the service has begun with the consumer’s prior express consent and consent.
The refund of payments made, including delivery costs (except for additional costs due to the choice of a type of delivery other than the most affordable standard form of delivery offered by the company) will be made as soon as possible, but no later than within 14 days of receiving the notice of withdrawal. The business returns the payments received to the consumer using the same means of payment as used by the consumer (which is most usually the case with payment to a transaction account), unless the consumer has explicitly requested the use of a different means of payment and the consumer does not incur any costs as a result.
 
When withdrawing from a contract where a bonus, discount code or promotional code was used, these funds will be considered as a discount and are not returned to the user. Only the paid amount will be refunded to the user. When withdrawing from the contract, the gift voucher is considered a means of payment and returned to the user as a gift certificate, and the paid amount is returned to the user.
 
In exceptional cases, when the items are not returned in accordance with the ZVPot, we may offer the consumer to buy the item with appropriate compensation, which we determine with the record upon return. Discounted buy-back is taken into account upon confirmation of the consumer by e-mail. The consumer uses this ransom exclusively when ordering another item of equal or higher value.
 
The right to a refund of the purchase price in case of claiming warranty and material defects is regulated in more detail by the provisions of the Consumer Protection Act.

WITHDRAWAL OF THE CONSUMER FROM THE CONTRACT FOR ITEMS SOLD IN A SET

If the consumer decides to withdraw from the contract for the items constituting the set, he may request an exchange for the same set or a refund of the purchase price for the complete set. The consumer can replace the item from the kit in case of a material defect or damage to the item, and cannot request a refund for it. In case of claiming warranty of the item from the kit, the warranty period of the manufacturer applies.
 
Items have a warranty if stated on the warranty card or on the invoice. The warranty is valid by following the instructions on the warranty card and presenting the invoice. The warranty periods are indicated on the warranty cards or on the invoice.
 
Information about the warranty is also indicated on the page with the presentation of the article. If there is no warranty information, the item has no warranty or the information is not known at this time. In the latter case, the customer can contact Creative Goods to provide up-to-date information.

MATERIAL ERROR

The consumer may exercise his rights arising from a material defect if he notifies the seller of the defect within two months from the day on which the defect was discovered. The consumer must accurately describe the defect in the error notice and allow the seller to inspect the item.
 
The seller is not liable for material defects on the goods, which appear after two years have passed since the item was delivered. The defect in the goods shall be deemed to have existed at the time of delivery if it occurs within six months of delivery.
 
A consumer who has correctly informed the seller of the defect has the right to require the seller to:
  • eliminate the defect in the goods or
  • return part of the amount paid in proportion to the defect,
  • or replace defective goods with a new faultless one, or Returns the amount paid.

WHEN IS A MATERIAL DEFECT MATERIAL?

A material defect is material when:

  • the item does not possess the characteristics necessary for its normal use or for circulation.
  • the item does not have the characteristics necessary for the specific use for which the buyer buys it, but which was known to the seller or should have been known to him,
  • the item has no characteristics and qualities that have been explicitly or tacitly agreed or prescribed,
  • the seller has handed over an item that does not match the pattern or model, unless the sample or model was shown only for the purpose of notification.

HOW IS THE SUITABILITY OF AN ITEM CHECKED?

It is checked with another, flawless item of the same type, as well as with the manufacturer’s statements or indications on the item itself.
 

HOW IS A MATERIAL DEFECT HANDLED?

The buyer must inform us of any material defect together with a detailed description of it within the statutory period and at the same time enable us to inspect the item. The form for reporting a material defect can be found here. The right to claim a material defect on an item is regulated in more detail by the provisions of the Consumer Protection Act.
 

COLLECTION OF ITEMS RETURNED FROM THE CONSIDERATION OF WARRANTY OR MATERIAL DEFECT

The buyer is obliged to collect the item handed over to the seller for warranty or other treatment after the completion of the treatment. The buyer picks up the item at the pick-up point where he personally handed it over to the seller, and in case he sent it by mail, it will be returned to the delivery address.
 
The seller sends the buyer a notice of return of the item from the treatment and asks him to collect the item. The buyer is obliged to pick up the item within 14 days from the date of notification.
 
If the buyer does not pick up the item within the stated period, the item is handed over for storage to the seller at the address of his warehouse: Creative Goods, s.p., Osterčeva ulica 1, 2000 Maribor, Slovenia. The seller keeps the item in its own warehouse until the expiration of 6 months from the date of notification. For this period, the seller has the right to reimbursement of all storage costs (1 € / day) and the right to reimbursement of all costs necessary for the preservation of the item.
 
After 6 months from the date of notification, the seller can sell the item through the Creative Goods online store and transfer the obtained purchase price to the buyer, after deduction of the seller’s sales and other costs. In the event that the value of the item is insignificant, the seller can donate it to charity and in this case the buyer is not obliged to make any returns. 15 days before the expiration of the 6-month retention period, the seller informs the buyer about the intended sale or donation of the item, and after the sale also about the achieved price and amount of costs and about the transfer of the remaining purchase price to the buyer’s transaction account.

Items with skinned packaging

Items with skinned packaging have been returned to Creative Goods and may have minor defects (damaged packaging/item, open packaging, etc.) and go for resale. The type of defects or the condition of the item are stated in writing for each item (both in the description of the item and on the invoice).
 
Returned items are reviewed in Creative Goods, so despite returns, open packaging, etc. They still allow normal operation. For this reason, a new warranty period is also determined accordingly, which is stated in writing next to each item.
 
In case of non-functioning of the returned item, the customer is entitled to warranty repair and to withdraw from the contract within the same deadlines as for other items.

TYPE OF DEFECT OF ITEM LABELED OPEN PACKAGING

  • Skinned packaging: The item has the packaging open, but it is impeccably working and perfect. The price is further reduced, the stated warranty period applies.
  • Damaged packaging: The item has damaged, incomplete or non-original packaging, but is malfunctioning. The price is further reduced, the stated warranty period applies.
  • Damaged item: The item has minor aesthetic damage, may show signs of use and may have damaged packaging. The price is further reduced, the stated warranty period applies.
  • Item used: The item has been returned by the customer. It has been used and may have slightly damaged packaging. The price is further reduced, the stated warranty period applies.
  • Serviced item: The item has been serviced at an authorized service. The item is flawlessly functioning. The price is further reduced, the stated warranty period applies.
Our contractual partners for parcel delivery in Slovenia are Pošta Slovenije and DPD, but Creative Goods reserves the right to choose another delivery service if this will allow it to fulfill the order more efficiently.
 
When purchasing new electrical and electronic equipment (EEE), you can dispatch waste electrical and electronic shipping (WEEE) free of charge at all our collection points. Waste electrical and electronic equipment (WEEE) that you will leave must be the same as supplied/purchased in terms of purpose of use and classification in the class of electrical and electronic equipment, and the number of items delivered must be equal to the number of supplied electrical and electronic equipment (EEE).

The user should be aware that he is obliged to provide his personal data to the online trader in the correct and true form, and he is also obliged to inform the online trader about the change in his data. By accepting these terms, the user confirms that the personal data provided by him/her is correct.
 
Creative Goods will contact the user by means of distance communication only if the user does not explicitly object, and in accordance with the provisions of ZEKom-1.
 
Creative Goods advertising emails will contain the following ingredients:
  • they will be clearly and unambiguously marked as advertising messages,
  • the sender of Creative Goods will be clearly visible,
  • various campaigns, promotions and other marketing techniques will be marked as such. The conditions for participating in them will also be clearly defined,
  • the method of unsubscribing from receiving advertising messages will be clearly presented,
  • the user’s desire not to receive advertising messages will be expressly respected by Creative Goods.

Creative Goods advertising messages will be clearly visible and clearly separated from games and competitions.

Feedback, reviews and recommendations written by customers are part of the functionality of the online store and intended for the community of all users.
 
Creative Goods allows any user of the online store to write reviews, and is reviewed by Creative Goods before final publication. Creative Goods will not post reviews or contributions that are in any way offensive, inappropriate, or that, according to Creative Goods, do not benefit other users and visitors.
 
By submitting a feedback or comment, the user expressly agrees to the terms of use of his opinion or comment and Creative Goods permits the publication of part or all of the text in all electronic and other media. Creative Goods has the right to use the content of an opinion or comment for an unlimited period of time and for any purpose that is in Creative Goods’ commercial interest, including posting in ads or other marketing communications. At the same time, the author of the feedback declares and warrants that he owns the material and moral copyrights to the written opinions and comments, and that he transfers these rights to Creative Goods on a non-exclusive and unlimited basis.
Creative Goods makes every effort to ensure that the information published on its websites is up-to-date and correct. However, item characteristics, delivery times, or price may change so quickly that Creative Goods fails to correct the information on the websites. In such a case, Creative Goods will notify the customer of the changes and allow him to withdraw from the contract or replace the ordered item.
 
Creative Goods is not responsible for the content of reviews of items written by visitors. Before posting, Creative Goods reviews and rejects reviews that contain obvious untruths, are inappropriate, misleading, or offensive. Creative Goods is not responsible for the information in reviews and is limited from any liability arising from the information provided in the reviews.
Creative Goods has the option of withdrawing from the contract only if a manifest error is found (Article 46 of the OZ). An obvious defect is considered to be a defect in the essential characteristics of an item and any errors that are considered decisive according to store customary or customer intention and which Creative Goods would not confirm or conclude a contract if known. This also includes obvious price errors.
 
Creative Goods complies with applicable consumer protection laws. Creative Goods makes every effort to fulfil its duty to provide an effective complaints handling system.

Creative Goods recognizes that an essential feature of consumer disputes is the disproportion between the economic value of the claim and the time required and the costs incurred in resolving the dispute, which is also the main obstacle for the consumer not to bring a dispute in court. Therefore, Creative Goods makes every effort to resolve any disputes amicably.
In accordance with legal norms, Creative Goods s.p. does not recognize any out-of-court consumer dispute resolution provider as competent to resolve a consumer dispute that a consumer could initiate in accordance with the Out-of-Court Resolution of Consumer Disputes Act.
